On November 20, 2019, the Centers for Medicare & Medicaid Services (CMS) announced that it utilized Civil Monetary Penalty (CMP) Reinvestment Funds to develop a 3-year program that will help improve the quality of life for residents, reduce adverse events, improve dementia care, and improve nursing home staffing quality by providing tools such as competencies, assessment tools, competency guides, training webinars, and technical assistance seminars. There are 3 toolkits but only one has been released: Toolkit 1 includes multi-level nursing home staff competency assessments that are behavioral, technical, and resident-based. This includes, CNAs, CMTs, LPN/LVNs, RNs, and all management staff. The toolkits include instruction manuals and other resources.
As the year comes to an end, nursing homes need to be aware that Phase 3 of the RoPs became effective 11/28/19. The Intergretive Guidance (IG) are expected to be followed and implemented in Quarter 2 of 2020. In addition, facilities can expect changes to the LTCSP as a result. Surveyors will still utilize the existing IGs. Providers are expected to be in compliance with all regulations. The statement from CMS is as follows:
“While the Phase 3 requirements will be effective November 28, 2019, and facilities are required to comply with these and all requirements, our ability to survey for compliance with these requirements will be limited until the Interpretive Guidance is released.”
